Tax Penalties: A Developing Danger

A revision to the preparer penalty standard in Code Sec. 6694(a), made by a provision in the Small Business and Work Opportunity Tax Act of 2007, affects virtually every tax professional. The provision changed the preparer penalty standard from a "realistic possibility of a tax position being sustained..." to a "reasonable belief that the position would more likely than not be sustained..." Practitioners and the IRS have been scrambling to understand the new more likely than not standard.

In June 2008, the IRS issued long-awaited proposed regulations under Code Sec. 6694. This course explains the Code Sec. 6694 changes, and highlights new questions generated by the proposed regs.
