Texas Margin Tax and Other Alternative Tax Structures
Author: Giles Sutton, Jamie Yesnowitz, Chuck Jones, Terry Conley, Ralph Ourlian, Doug Mazuir, John LaBorde, Pat O'Shea, Brian Etmer and Robert Sash

Description:
In recent years, there has been a discernible trend among state and local tax jurisdictions toward varying forms of alternative tax structures, in many cases, based on gross receipts. As such, these tax schemes parallel the traditional gross receipts tax. While many gross receipts taxes are imposed broadly on the privilege of engaging in business in a state, others are levied more narrowly, such as on particular lines of business.

Focusing on the state gross receipts programs of Washington, New Jersey, Ohio, Michigan and Texas, Texas Margin Tax and Other Alternative Tax Structures seeks to highlight concerns over the deleterious effects of these taxes on certain business segments, the constitutional and fairness issues, as well as how these states have sought to address such issues. This course will also provide greater detail with respect to the newer gross receipts programs in Ohio and Texas.

Topics covered in this course include:

  • Washington's Business & Occupation Tax
  • The Michigan Business Tax
  • Ohio Commercial Activity Tax
  • Texas' New Margin Tax
  • Pyramiding Effect of the Un-Income Tax Approach
